Vox: Study Shows High-Skilled Immigrants Create Jobs for Americans

Eric Cantor's Loss Won't Kill Immigration Reform

The moments after Majority Leader Eric Cantor's shocking primary defeat are sort of like the political equivalent of a post-Apocalyptic event that no one thought would actually happen. And now when the figurative dust settles and everyone wraps their minds around this "new normal," immigration-reform backers will have to beat back the perception that support for immigration proposals is what brought down one of the most powerful men in Washington.

U.S. Moves to Stop Surge in Illegal Immigration

White House officials, saying that misinformation about administration policies helped drive a surge of illegal migrants from Central America across the South Texas border, on Friday announced plans to detain more of them and to accelerate their court cases so as to deport them more quickly.

House Expects Business as Usual After Cantor Goes

TIME reports that later today, House Majority Whip Kevin McCarthy (R-CA) will likely be voted to replace Eric Cantor as House Majority leader.* Although McCarthy favors a path to legal status for undocumented immigrants, though not full citizenship, many representatives foresee that his election will not alter the Republican Party trajectory on immigration reform.

Why more skilled immigration would be good for American workers, too?

Why more skilled immigration would be good for American workers, too. A March 19 article in the Washington Post highlights how skilled immigration is a plus for the economy, workers, and job creation in the U.S. The article notes that, compared with other OECD countries, U.S. immigration policy allows in relatively few skilled foreign-born innovators. As the article states, “many of the STEM students educated at U.S. universities who can’t get visas to stay and work here wind up in some of those other countries.” As the article notes, bringing in more high-skilled foreign-born workers wouldn’t displace native-born workers: there is a “gap between businesses looking to fill high-skilled jobs and an education and training system that isn’t producing the right workers to take them.”

H-1B Program’s Impact on Wages, Jobs, and the Economy

High-skilled foreign-born workers contribute to places throughout the country and to America’s innovation economy. A new report from the American Immigration Council (AIC) provides an overview of recent research about the H-1B visa program and its impact on wages, jobs, and the economy.

As the report states, “every year, U.S. employers seeking highly skilled foreign professionals have rolled the dice on April 1 and submitted their applications for the limited pool of H-1B visas available each fiscal year. With only 65,000 visas available for new hires—and 20,000 additional visas for foreign professionals who graduate with a Master’s or Doctorate from a U.S. university—in recent years demand has far outstripped the supply and the cap has been quickly reached.

In 2013, the H-1B visa cap was reached within a few days. Understanding the H-1B process is important to understanding the vital economic role that higher-skilled immigration plays in growing our economy and creating new opportunities for native and foreign-born workers alike.” An April 7 post on Immigration Impact noted that the H-1B cap for Fiscal Year 2015 was reached within the first week of the filing period.

New Immigration Development

Our attorneys are working on several cases involving the possibility that persons who entered the U.S. without inspection (EWI) granted temporary protective status (TPS) may be eligible to adjust their status to permanent resident.

Of course, the applicant must be the beneficiary of an approved visa petition and be either quota exempt or have a visa number available. New developments in judicial case law allow some EWI TPS grantees to qualify even though they were not inspected and admitted. This is based upon a provision in the statute which regularizes the nonimmigrant status of TPS grantees.

The other possibility is to obtain a TPS travel document, advance parole, depart foreign and apply for parole at a port of entry. If paroled, the applicant may be eligible to adjust as one who has been inspected and admitted or paroled.

Customs and Border Protection Releases Long-Awaited Review and Use-of-Force Policy

Washington D.C. - Today, after numerous formal and informal requests from border advocates and a lawsuit, U.S. Customs and Border Protection (CBP) released a 2013 report by the Police Executive Research Forum (PERF), a nonprofit research organization, analyzing the agency’s use-of-force policies and practices. CBP commissioned the report after receiving inquiries from sixteen Members of Congress following a series of deaths during encounters with CBP personnel. CBP also released its new Use of Force Policy, Guidelines and Procedures Handbook.


At first glance, CBP appears to have incorporated a number of PERF’s recommendations into its handbook, but a closer analysis is necessary. While policy change is critical, PERF rightly noted in its report that “CBP will need to craft an implementation strategy for re-orientation and training before new policies go into effect.”  Effective training and periodic retraining, coupled with better oversight and accountability mechanisms, will be critical for real change to take hold.


While the release of these documents represents an important step toward greater openness in an agency long known for secrecy, this is merely the first step in a very long process. The real measure of success will be how quickly and effectively CBP is able to adopt and implement policies that rein in abuse and whether it will develop a culture of transparency and accountability.
